The following day, Smith-Pequeno reportedly returned with three others and stole an additional $12,000 in merchandise in the process, causing significant property damage.

Evidence against Smith-Pequeno includes a witness report of him and a juvenile changing clothes on the street after the second theft, attempting to discard stolen goods. While fleeing responding officers, Smith-Pequeno allegedly fell and was arrested. Despite the gravity of the crimes, a preliminary hearing set for March 13 will see Smith-Pequeno, who pleaded not guilty, released on his recognizance with conditions to stay away from the Castro Street Walgreens and to engage in weekly assertive case management phone check-ins.

Jenkins stressed the importance of the criminal justice system recognizing and addressing the community impact of organized retail theft, suggesting a more systemic approach to dismantling criminal enterprises. The DA's request for pretrial detention was overruled, echoing current debates on how to balance public safety with the rights of the accused.
