In a recent declaration, DuPage County State’s Attorney Robert Berlin confirmed that two officers acted within the law during a fatal shooting incident in Aurora. The officers involved, Plano Police Officer David Svehla and Kendall County Sheriff’s Deputy Tyler Giannotti, will not face charges for the September 27, 2024, shooting of Nicholas Novak, FOX 32 Chicago reports.
The case began with a reported home invasion at the residence of Novak's father, who later succumbed to gunshot wounds. What ensued was a 25-minute car chase leading to a confrontation at Route 34 and Eola Road, where Novak emerged from the vehicle clutching a shotgun and was subsequently shot by the officers. According to the investigation, Novak had exhibited suicidal tendencies, with notes on his phone and internet search queries such as "suicide by police," Berlin's office detailed in the thorough investigation, which included various witness interviews, video evidence, and forensic reports.
Berlin stated that the officers "feared for their lives and the safety of others" when they encountered Novak armed and noted their response as "objectively reasonable," a sentiment supported by video evidence and the unfolding situation officers were confronted with, as reported by DuPage County State’s Attorney’s official announcement.
Despite the chaotic nature of the incident, no officers were hurt. The use of deadly force was deemed legally justified under Illinois law, with Berlin specifically citing that the officers believed their conduct was crucial to defend against "imminent death or great bodily harm." The decision, Berlin insisted, was also based on the totality of the circumstances, including Novak's actions during the police chase, his threatening behavior with the shotgun, and indications of an intent to commit "suicide by cop," coupled with his elevated blood alcohol content at the time of his death.
Berlin extended his condolences to the Novak family, acknowledging the loss they have suffered. He further commended the officers for their professionalism and prompt medical attention given to Nicholas Novak post-shooting. The investigation, led by the Illinois State Police, was recognized for its thoroughness in bringing clarity to this tragic situation that ultimately led to Berlin's determination of justifiable use of force.
