Additionally, Assistant U.S. Attorney Sarah Seberger pointed out the familial or trust relation often found in child victimization cases, noting that the "level of cruelty and abuse" inflicted on the victim was of a particularly "heinous nature."

U.S. District Judge Colleen R. Lawless applied several sentencing enhancements due to Westemeyer's leadership role in the offense and the fact that the victim was under his care. "Children should never be subjected to the depraved behavior demonstrated by this defendant," Matthew Scarpino, Special Agent in Charge of ICE Homeland Security Investigations, said, “Thanks to the outstanding teamwork and tireless effort by HSI special agents and our law enforcement partners, this child predator has been removed from the community and put in federal prison for a 30-year sentence.”

The collective effort of multiple law enforcement agencies led to the outcome of the case. Westemeyer has been in custody since his arrest and entered a guilty plea in July 2024. The sentence handed down corresponds with federal statutes for sexual exploitation of a child, carrying penalties ranging from 15 to 30 years’ imprisonment, up to a lifetime of supervised release, and significant fines.
