The Boynton Beach restaurant scene was recently shaken by news of an owner's alleged misconduct with sales tax payments. Kenson Fevrier, 41, faces a grave accusation of second-degree felony for purportedly unremitted sales taxes amounting to $38,000. This incident was reported to have occurred over a period stretching from May 2020 to November 2024, at Ney Caribbean Restaurant LLC, located on South Military Trail.

An extensive investigation by the Florida Department of Revenue indicated that Fevrier had collected $38,337.47 in sales tax but consciously chose to turn over only a minuscule $339.51 to the state. According to CBS12, despite the business's obligation to file monthly sales and use tax returns, Fevrier allegedly ignored multiple communication attempts by the Department's specialists.

Official documents paint a picture of a proprietor who was well aware of his responsibilities yet failed to comply. The department's revenue specialists documented numerous attempts to reach out to Fevrier and even conducted field visits. During these exchanges, Fevrier is said to have acknowledged his duty to submit tax returns and remit the collected taxes, as per the CBS12 report.

With little to no cooperation from Fevrier, investigators were left with no option but to obtain subpoenas to access Ney Caribbean Restaurant's business records, which included detailed bank statements and point-of-sale data. Data provided by Fiserv, a payment processing company, showed concrete evidence that Fevrier had indeed collected the taxes in question. Moreover, corroboration from bank records indicated he had sufficient funds in both Citibank and Bank of America accounts to have remitted the taxes owed, suggesting an intentional act of failing to do so.

As a result of the investigation, Fevrier was arrested on a charge of larceny for failing to remit sales tax upwards of $20,000 but less than $100,000, according to booking information from Recently Booked. The booking number 2025012628, dated 5/14/2025, confirms his arrest and the nature of the felony charge brought against him.
