
The City of Portland has taken a clear stance in refining the operation of Accessory Short-term Rentals (ASTRs), particularly when it comes to citations and the financial weight they carry. Those looking to rent out their space on platforms like Airbnb or VRBO should take note that, as of July 1, they'll be facing increased fees for permits and violations, all designed to adjust for inflation and strengthen enforcement measures.
Donnie Oliveira, Deputy City Administrator for Community & Economic Development, underscored the motive behind the hike: "By rightsizing fees associated with short-term rentals and working with our partners to keep operators informed, we are ensuring good actors can continue to operate short-term rentals while curbing those who exploit our vulnerable housing stock." This comment was released by the City of Portland, reflecting a balanced approach to regulation and support for compliant ASTR operators.
The new fees fall somewhere between a 5–6% increase for initial, renewal, and delinquent charges for both Type A and Type B ASTR permits. These categories are generally associated with short-term rentals within residential zones. What's more is that fines for running afoul of the rules will see an uptick as well. If an operator is found in violation during an inspection, the penalties can accumulate quickly. Depending on the number and type of infractions, a single violation can lead to a fine for one offense, and if multiple issues are discovered, this can stack up to five different types of fines.
Perhaps most significant is the fines reach under the present fee schedule―capping at a hefty $26,201 for FY24-25. For those found in violation, if issues aren't remedied posthaste or, if corrected, are repeated, the city's next step could be a formal complaint to the Hearings Officer which might trigger further penalties, or even legal action. Additionally, to support ASTR operators in sidestepping these financial pitfalls, the city is rolling out outreach efforts to ensure everyone is up to speed on the particulars of ASTR requirements in Portland. This includes details on permitting, occupancy rules, and defining which spaces qualify for short-term rental use.
