
The fight for fair wages continues as the Illinois Department of Labor (IDOL) recently clamped down on wage theft, recovering over $85,000 owed to 17 workers from a solar panel installation project in Saline County. This move underscores not just the agency's commitment, but also Illinois' legislative dedication to ensuring workers on publicly funded projects are compensated fairly under the Prevailing Wage Act.
According to a press release from the State of Illinois, the wage recovery stems from an investigation into D&D Electric, LLC, an electrical contractor based out of Harrisburg, Illinois. Their violations included failing to adequately classify workers, which in turn affected the rightful distribution of overtime payouts and fringe benefits. Jane Flanagan, IDOL's director, emphasized, "Illinois law requires that employees on publicly funded projects be paid a fair wage for their skilled work." She added that making these workers whole "reflects IDOL's commitment to enforcing the Prevailing Wage Act and holding employers accountable when they violate workers' rights."
Beyond recouping unpaid wages, IDOL obtained over $17,000 in penalties from D&D Electric, signaling a stark message to contractors engaged in public works projects: compliance with state labor laws is not optional. The debated Prevailing Wage Act necessitates that contractors and subcontractors pay no less than the general prevailing rate of wages, inclusive of hourly cash wages plus fringe benefits, corresponding to the sort of work performed in the locality of the project, as per the State of Illinois.
With the Illinois Climate and Equitable Jobs Act (CEJA) in effect, these enforcement steps reflect increased vigilance to protect laborers in new clean energy sectors. CEJA ensures that projects incentivized through the Illinois Power Agency extend the obligation of paying prevailing wages.
