According to a press release from the Knox County DA's Office, 60-year-old Girish Dhirubhai Desai was ordered to serve 28 days in jail after being convicted of Driving Under the Influence, a sentence which far exceeds the mandatory minimum of a 48-hour incarceration.

Desai's conviction stems from a September 7, 2023, incident where officers found him unconscious in a running vehicle in the middle of a neighborhood street. "We are continuing to aggressively prosecute DUI cases because impaired driving can have such a devastating effect," DA Charme Allen stated. "You cannot avoid responsibility by refusing to submit to a blood draw.  If you were intoxicated, we will take you to trial and seek a conviction." Despite Desai's refusal to submit to a blood alcohol test and his defense pointing to a possible diabetic episode, the jury returned a guilty verdict swiftly after a two-day trial.

Additional details provided during the court proceedings revealed that this was not Desai's first run-in with impaired driving allegations. The enhanced jail sentence was influenced in part by previous arrests in which Desai also refused sobriety tests. Moreover, while awaiting trial for the current case, he incurred ignition interlock violations. The jury also imposed a $1000 fine upon reaching their verdict, highlighting the seriousness of Desai's offense.

As a part of his sentence, Desai will be required to wear an alcohol monitoring bracelet, ensuring that he abstains from alcohol consumption. This measure is meant to offer a layer of protection against potential future incidents, a testament to the diligence Knoxville authorities are placing on DUI offenses.
