The conviction of a motorist responsible for the deaths of two individuals has brought a somber reminder of the fatal consequences of impaired driving. The Knoxville County District Attorney's Office announced that 35-year-old Eduardo DeAvila was found guilty on charges stemming from a deadly incident that occurred on Pellissippi Parkway. DeAvila was convicted of two counts of Vehicular Homicide, Vehicular Assault, along with Aggravated Assault, and Reckless Endangerment, according to a press release by the District Attorney's Office.
During the trial, which spanned four days, Assistant District Attorneys Mitch Eisenberg and Caleb Smothers presented evidence to the jury that on November 18, 2022, DeAvila had driven against traffic for over five miles, causing a lethal multi-vehicle collision. The accident, which occurred around 1:30 AM, resulted in the death of two drivers and severe injury to a passenger. Having nearly missed two other vehicles in the process, despite being convicted, the defense claimed the victims were at fault, reported the District Attorney's Office.
With the presentation of the blood tests showing a blood alcohol content of .212, over twice the legal limit, and the presence of cocaine, the jury delivered guilty verdicts after one hour of deliberation. The stark reality of the incident is underscored by District Attorney Charme Allen's comments on the lethality of driving under the influence: "This is why we aggressively enforce DUI laws,” said DA Allen. “Impaired driving can have such devastating consequences like the ones that ended up happening in this tragic case."
Eduardo DeAvila is now facing Class B felony charges, with prosecutors pushing for consecutive sentences to reflect the individual loss of each victim. Judge Hector Sanchez ordered the revocation of DeAvila's bond as he awaits sentencing scheduled for August 22, as the District Attorney's press release details. Assistant Victim Witness Coordinator Jennifer Stout collaborated in the prosecution efforts, providing support for a case that echoes the grim toll of DUI incidents across the nation.
