Following the incident, police arrested 36-year-old Juan Diazrivas, who now faces charges outlined in section 245(a)(4) of the Penal Code. He was taken into custody and booked into San Francisco County Jail. Meanwhile, having developed probable cause based on the investigation at the scene, the second male suspect was cited for battery under section 242 PC but was released shortly after. Officers at the scene gathered enough information to pursue this matter as a hate crime, an angle that is still under scrutiny by authorities.
The San Francisco Chronicle detailed further aspects of the event, reporting an antisemitic motive behind the assault. As per the SF Chronicle, Alana Gans, a friend of the victim, recounted the terrifying ordeal. Gans, who is Jewish, and her friend were waiting for an Uber when they were subjected to hate speech. The verbal attack swiftly turned violent when a man directed antisemitic remarks at them, with others recording and laughing at the situation as it escalated into a physical confrontation.
"F— Jews, free Palestine," the man shouted, persisting for approximately a minute before the assault began. It was after Gans stood up and defended herself that the violence ensued. "Other men jumped in and kicked her friend, repeating the anti-Jewish remarks and laughing," Gans told the SF Chronicle. The incident also saw a brave employee from the nearby Balboa Cafe who attempted to intercede, being pushed and kicked to the ground. The attack left Gans's friend with a visibly swollen lip and multiple bumps on his head.
