
The San Francisco Police Department reports the arrest of a known shoplifter, Neil Peck, better known as Kevin Peck, last Sunday. The 51-year-old male faced allegations of burglary and attempted grand theft after being apprehended on Mission St. Incorporating a new penal code brought to light by Proposition 36, Peck was charged with multiple offenses based on a history of repeat thefts.
An observant patrol officer first suspected Peck's recurrent thefts and engaged the SFPD's Defend Against Retail Theft (DART) Organized Retail Crime (ORC) Task Force to investigate. Passed by voters and enacted on December 18, 2024, Proposition 36 introduced CA Penal Code 666.1. This law considers petty theft a wobbler, either a misdemeanor or felony, if the individual has past theft convictions, a situation Peck found himself in with several prior convictions.
The SFPD DART investigators dug deeper into Peck's history, linking him to 16 additional cases with chargeable offenses between October 7, 2024, and May 22, 2025. The total loss from these alleged incidents reached nearly $8,000. According to the San Francisco Police Department, Peck was still in custody for last Thursday's latest incident.
Consequent to discussions with the San Francisco District Attorney's Office Organized Retail Theft prosecutor, Peck found himself under arrest facing the following charges: 16 counts of Petty Theft with Prior (666.1(a)(1) PC/Felony), one count of Second-Degree Commercial Burglary (459 PC/Felony), one count of Grand Theft (487(a) PC/Felony), and one count of Shoplifting (459.5(a) PC/Misdemeanor).
