
Jorge Adan Fontes-Garcia, a 26-year-old from Sonora, Mexico, has been sentenced to over a decade in prison for his role in an alien smuggling operation that resulted in a tragic death. On August 5, the United States District Court imposed a 130-month incarceration period, which will be followed by 60 months of supervised release. The sentence comes after Fontes-Garcia's May 20 guilty plea to Bringing an Illegal Alien to the United States Unlawfully Resulting in Death.
The case against Fontes-Garcia highlighted a perilous journey initiated on August 23, 2023, where he led a group of eight individuals across the Mexico-United States border into the harsh terrain of southern Arizona. The United States Border Patrol managed to apprehend all but one member of the group, around 19 miles south of Tacna, Arizona. Regrettably, the last individual was discovered deceased, having succumbed to the brutal desert heat exposure, said United States Attorney Timothy Courchaine. "This case demonstrates that human smugglers often have little regard for those entrusted to their care."
Fontes-Garcia had previously been convicted for Reentry of an Illegal Alien, which this case also addressed in terms of violating federal supervision. Chief Patrol Agent Justin De La Torre of the Yuma Sector Border Patrol remarked on the broader risks posed by human smuggling, citing the numerous deaths it causes annually. "This sentence sends a clear message to anyone considering smuggling foreign nationals into the country – ‘if you do, we will arrest you, and you will be held accountable,’" De La Torre asserted.
This legal development falls under a larger umbrella initiative titled Operation Take Back America. The operation unites extensive resources and efforts from the Department of Justice to repel illegal immigration, dismantle cartels, and safeguard communities from violent crime. The investigative force behind the case was the Customs and Border Protection’s United States Border Patrol, with the United States Attorney’s Office, District of Arizona, leading the prosecution.
