The judge's decision stems from an altercation during Kelly's regular ICE check-in on August 4. Despite his pending asylum hearing, Kelly faced detention offers and was given an unacceptable ultimatum: pay $1,000 to self-deport to Jamaica or be detained. Kelly refused the offer and was held at a temporary detention site at 26 Federal Plaza, which is known for its dreadful and overcrowded conditions. The intervention by U.S. District Judge Analisa Torres, as described by a the Advocate report, occurred after more than two weeks of Kelly's detention, emphasizing the breach of his due process rights.
Court records affirm that Kelly, who entered the U.S. with a tourist visa in May 2021 and filed for asylum within the same year, was employed as a security guard in New York City.
