
In a concerning turn of events at Marshall Elementary, deputies with Constable Mark Herman’s Office intervened in a situation that could have sparked off tragedy. Acting on alerts from school personnel, authorities found Luis Funes Rodriguez asleep at the wheel, the car running, amidst the coming-and-going of the school’s pick-up line. This incident occurred on the 24400 block of Birnamwood Boulevard within the Spring ISD jurisdiction.
An apparent case of driving under the influence was promptly addressed when school staff observed Rodriguez creating a traffic jam during one of the busiest times of the school day. Upon arrival, deputies found clear evidence of intoxication, including the driver’s impaired state and the presence of two beer cans in the vehicle, according to a statement from Constable Mark Herman’s Office on Facebook.
The deputies conducted Standardized Field Sobriety Tests and it wasn't long before they determined Rodriguez's condition surpassed safe limits. Not long after, a family member stepped into diffuse the dangerous situation, arriving to safely collect the child that was supposed to be in Rodriguez's care. Child Protective Services has entered the scenario, following protocol in such cases that brush so close with danger to the youth.
Following his detention, Rodriguez was charged with Driving While Intoxicated and transported to Harris County Jail. The bond was set at a scant $100.00 out of County Court 5. The gravity of the situation was underscored by Constable Mark Herman's remarks: “Driving intoxicated is dangerous enough, but doing so in a school zone during dismissal is completely unacceptable," as reported by the Precinct 4 Facebook page.
