
In a resolution that echoes the reverberations of history, a Buckhead condominium community has come to terms with the responsibility of preserving a historic Black cemetery. The Bluffs at Lenox Homeowners Association, after a nearly two-year court dispute, must now finance the upkeep of the Piney Grove Cemetery and ensure its accessibility, this follows a ruling by a Fulton County Superior Court judge last month.
According to FOX 5 Atlanta, the cemetery, a resting place dating back to the 1820s for over 300 Black men, women, and children, had been poorly maintained leading to the court battle initiated by descendants of those interred. Wright Mitchell, president and CEO of the Georgia Trust for Historic Preservation, told FOX 5 Atlanta, "It’s not just a win for Piney Grove, but it’s a big win for similar cemeteries across the state of Georgia." The HOA will also be required to allow the public access during the day, despite the ruling permitting them to restrict access at night.
Adding legal weight to the descendants' claim, the Superior Court of Fulton County ruled in favor of the Friends of Piney Grove Cemetery and descendants, as detailed by CBS News Atlanta. The court's decision encapsulates that the Buckhead condominium community's HOA not only has a duty to maintain the burial ground but must also comply with city zoning conditions and Georgia law that protect such historical sites.
Historically, Piney Grove Cemetery stands as a testament to the robust Black communities that once flourished in what is now Buckhead, prior to it being engulfed by upscale residential development. The judge's order, according to CBS News Atlanta, cemented the public status of Piney Grove Cemetery and explicitly refuted the Bluffs at Lenox Homeowners Association's argument for the site's privateness. Moreover, the order recognized descendants Rhonda Jackson and Audrey Collins' rights to legally access, look after, and preserve their forebears' gravesites.
Both parties have been tasked by the court to craft a detailed plan ensuring the restoration and safeguarding of Piney Grove Cemetery for future generations.
