A late-night walk along the East Freeway ended in tragedy early on Sunday when a man was hit and killed near Garth Road, according to Houston-area police. Officers say the crash happened around 12:30 a.m., and first responders pronounced the victim, described as a 34-year-old man, dead at the scene. The driver was detained and is now facing a charge of driving while intoxicated.
Baytown-area officers found the man lying in the roadway and arrested the driver at the scene, according to Click2Houston. The outlet reported that investigators have not yet said whether prosecutors will push for more serious charges as they sort through what happened.
Where It Happened
The East Freeway and Garth Road interchange cuts through a high-traffic stretch of Baytown that has already seen its share of deadly encounters for people on foot. In one recent example, an elderly pedestrian was killed in April in the parking lot of the Walmart at 4900 Garth Road, as reported by ABC13, highlighting ongoing concerns about pedestrian safety in the corridor.
Potential Charges Under Texas Law
When someone dies in a crash involving an allegedly intoxicated driver, the legal stakes can rise quickly. Under the Texas Penal Code, prosecutors may pursue an intoxication manslaughter charge if they determine that intoxication caused the death. As outlined in Texas Penal Code §49.08, that offense is a felony carrying significant potential prison time and fines.
Investigation Ongoing
Authorities say the case remains under active investigation, and officials have not yet publicly released the names of the victim or the driver. As Click2Houston noted, it will ultimately fall to prosecutors to decide whether to seek upgraded charges once they review all the evidence.
