
In an attempt to actively shield Arizona households from being priced out of homeownership, State Representative Nick Kupper has introduced a new bill, HB 2325, also known as the Own Something and Be Happy Act. The bill, setting its sights on the immense power wielded by large institutional investors in controlling the single-family housing market, proposes to directly limit corporate ownership of homes and institute a period where these investors are barred from competing with families for purchasing homes.
The legislation, as detailed in a document provided by the Arizona State Legislature, moves to cap the number of single-family homes that institutional investors can own at 50 statewide and implements a 60-day waiting period during which these entities would be prohibited from bidding on new listings. "Homeownership has long been central to the American Dream and the reward for hard work. When large investment firms buy up neighborhoods, families lose and prices climb," Rep. Nick Kupper was quoted in the statement.
This legislative push aligns with national policy priorities previously touted by President Trump, who has advocated for banning large institutional investors from buying more single-family homes and called for Congress to put protective measures for American homebuyers into law. Representative Kupper's bill is intended to offer Arizona residents a fair chance to compete for homes within their own communities, as they face population growth and a limited housing stock that has put pressure on first-time homebuyers.
Exceptions to the bill include nonprofit affordable housing providers, government housing agencies, community land trusts, as well as small property owners and modest-sized pension or fiduciary funds. These measures also come along with mandated annual reporting to the Arizona Department of Housing and allows for enforcement by the Attorney General. Local prosecutors have been empowered to act should the state chooses not to engage in enforcement.
Representative Kupper, a Republican from Legislative District 25 which includes parts of Maricopa, Yuma, and La Paz Counties, also serves as the Vice Chairman of the House Ways & Means Committee.
