According to the El Paso County Sheriff's Office, deputies arrested 26-year-old Tyrese Riley early on January 4, 2025, following the incident near mile marker 39. Exhibiting signs of intoxication, Riley also had his two children, ages 3 and 6, in the car at the time of the crash.

The deputies responding to the scene discovered Riley exhibiting clear signs of intoxication and later confirmed he had a blood alcohol concentration of 0.12, which is above the legal limit of 0.08 in Texas. Riley, who was involved with another vehicle in the crash, was taken into custody and charged with Driving While Intoxicated with a Child Under 15 Years of Age. Additionally, the authorities found that Riley had nine outstanding traffic warrants.

After the incident, Riley was transported to the El Paso County Detention Facility. He was given a $10,000 personal recognizance bond for the charge related to intoxicated driving with a minor. El Paso County Sheriff Oscar Ugarte stressed the severity of the offense, particularly due to the involvement of children. "Driving while intoxicated is dangerous on its own, but putting children in harm’s way makes this incident especially troubling," Ugarte said in the social media post by the El Paso County Sheriff's Office.
