After an extensive trial in Memphis, gynecologist Dr. Sanjeev Kumar has been found guilty on the majority of federal charges against him. According to Action News 5, the jury convicted Dr. Kumar, 45, of 40 out of 46 charges including healthcare fraud and misuse of medical devices. Despite facing these serious allegations, Dr. Kumar was not detained and will remain out on bail until his sentencing, which has not yet been scheduled.
Details from the court proceedings as reported by Local Memphis include the jury's consensus on 16 counts of Adulteration of Single-Use Devices, 16 counts of Misbranding of Reprocessed Single-Use Devices, and numerous counts of Health Care Fraud. The verdict comes following three weeks of trial deliberations, and Kumar’s attorney's statement that the cleaning process used was approved by the Centers for Disease Control and Prevention and by other doctors within the community. Kumar maintains his innocence and a plan to appeal has been announced.
During a press conference, Dr. Kumar stood by his actions, asserting, "I feel very disappointed, but at the same time respect the process, and I also firmly believe that I served every patient like a family member," as reported by Action News 5. The defense and Dr. Kumar appear ready to challenge the jury's findings, suggesting confidence in the science behind his medical practices.
The conviction could result in a substantial prison sentence for Kumar. An ABC24 reporter in the courtroom conveyed that Kumar could face up to 100 years of incarceration. A mistrial was declared on the six remaining counts where the jurors could not reach a unanimous decision, as mentioned in FOX13 Memphis report. Dr. Kumar is scheduled to return to court for sentencing on April 19 at 9:00 a.m.
