According to 11Alive, which cites a Facebook post from the City of Atlanta Police Department, officers identified the suspect as 28-year-old Qwantavis McClure. The outlet reports that McClure was charged with armed robbery, aggravated assault, and giving false information to a law enforcement officer after the incident in the 595 block of Ralph David Abernathy Boulevard SW. Investigators reportedly located a prop firearm during their probe, and 11Alive notes that police released an image of the item credited to the City of Atlanta Police Department.
Replica weapons can carry felony exposure
Georgia's armed-robbery law does not cut slack for fake guns that look like the real deal. The statute allows prosecutors to treat “any replica, article, or device having the appearance” of an offensive weapon as enough to support felony armed-robbery charges. That language appears in Georgia Code O.C.G.A. § 16-8-41, available via Justia, and the crime carries a mandatory minimum prison exposure within the state's sentencing range. Courts have upheld convictions where a replica or toy gun reasonably appeared to be a weapon to the victim at the time of the offense.
