The Justice Department has opened its investigative eye on educational practices in Michigan, in particular, three school districts of Detroit, Godfrey-Lee, and Lansing, for their integration of sexual orientation and gender ideology in classroom teachings from pre-K through grade 12. Announced by the Justice Department’s Civil Rights Division, this probe seeks to determine compliance with notifying parents on curriculum content and the safeguarding of single-sex spaces based on biological sex.
Assistant Attorney General Harmeet K. Dhillon of the Justice Department’s Civil Rights Division framed the investigation as a commitment to "ending the growing trend of local school authorities embedding sexuality and gender ideology in every aspect of public education." According to a statement obtained by the Justice Department, the inquiries are centered not only on educational content but, also on parental rights and Title IX compliance - especially as it relates to Mahmoud v. Taylor, a recent Supreme Court case.
Title IX of the Education Amendments of 1972, central to the investigation, is designed to protect people from discrimination based on sex in education programs or activities that receive federal financial assistance. The Michigan School Districts, beneficiaries of substantial taxpayer funds, are under the microscope to ensure they adhere to these federal statutes. With no conclusions yet drawn by the Civil Rights Division, the review is still in its preliminary phases.
Dhillon’s statement further stressed the importance of parental influence over a child’s religious upbringing including the "right to direct the religious upbringing of their children, which includes exempting them from ideological instruction which conflicts with their families’ sincerely held religious beliefs." The protection for children, in terms of access to facilities aligned with their biological sex, is also a noted concern. The statement articulated Title IX’s role in preserving the "safety, dignity, and innocence" of school-aged individuals, ensuring they can use bathrooms and locker rooms according to biological sex, as stated by the Justice Department.
