A confrontation at Mount Echo Park earlier this month has a Cincinnati man facing a felonious assault charge after police say he opened fire on another man during a heated run-in on April 5.
Court records state that 46-year-old Jimmy Small was arrested and booked into the Hamilton County Justice Center following the incident. A judge set his bond at $50,000 secured and ordered that he not possess any firearms while the case moves through the courts. Filings in the case, as reported by WLWT, spell out the bond terms and the firearm restriction.
Small is scheduled to return to court on April 27, according to those same court records.
Where it happened
The alleged shooting unfolded inside Mount Echo Park on Cincinnati's west side, a neighborhood spot that locals know more for its river views than for police tape. The park, listed at 251 Mount Echo Park Drive, includes an overlook and pavilion that draw regular visitors. According to TripAdvisor, it is a modest urban green space with views of the river valley.
Conflicting accounts
From there, the stories diverge. Small's attorneys say he fired his weapon in self-defense after being attacked. Prosecutors, pointing to the victim's account, say the confrontation started after allegations that Small had been harassing the man's daughter and would not back off. Those clashing narratives, outlined in filings referenced by WLWT, are expected to sit at the center of both sides' strategies as the case progresses.
Legal implications
Felonious assault in Ohio is codified at Ohio Revised Code.
