Authorities in Broward County say a 25-year-old North Lauderdale man is behind bars after a 17-year-old girl told investigators she was sexually assaulted at a Holiday Inn in Boca Raton. The teen, who had previously been reported missing out of Davie, told detectives she met two men in a hotel room and that things turned violent after she refused to have sex. Police say the investigation is still active and that criminal proceedings are underway.

Police Account and Charges

According to WPBF, detectives identified the suspect as Malik Juante Mackey, 25, of North Lauderdale. He faces multiple charges, including sexual battery on a victim between the ages of 12 and 17, unlawful sexual activity with a minor, soliciting or luring a child, harmful communication to a minor and using a two-way communications device to facilitate a felony.

The outlet reports that the arrest affidavit describes the teen arriving at the Boca Raton hotel and meeting Mackey and another man in a room. Investigators told reporters that a review of text messages and Instagram conversations revealed discussions about meeting at hotels, along with sexually explicit exchanges they say line up with the teen’s account.

Why Some Victims Wait to Report

Detectives said the teen did not immediately report the alleged assault because she was afraid of Mackey and the other man, a reaction law enforcement and advocates say is all too common.

Data from RAINN shows that only about 31% of sexual assaults are reported to law enforcement. Fear of retaliation is one of the top reasons victims say they stay silent, along with shame, uncertainty about whether they will be believed and not knowing where to seek help.

What the Charges Mean

Under Florida law, anyone 24 or older who has sexual activity with a 16- or 17-year-old can be charged under the state’s unlawful sexual activity with certain minors statute, a second-degree felony. That provision is spelled out in Florida Statute 794.05.

Separate counts such as solicitation, harmful communications to minors or using electronic devices to facilitate a felony each bring their own potential penalties if a defendant is convicted. Court records indicate the case involving Mackey is pending while prosecutors review the evidence and determine how to proceed.

Investigation and Next Steps

Investigators say GPS-monitoring data placed Mackey at the Boca Raton Holiday Inn during the time frame in question. Authorities told WPBF that he was arrested on July 11 in Broward County on a pretrial-release-warrant violation.

Detectives attempted to question Mackey, but say he invoked his right to an attorney and declined to answer their questions. Prosecutors have not announced whether additional charges will be filed, and court dockets show the matter remains active.

Investigators are asking anyone with information about the case to contact detectives with the Broward Sheriff’s Office. Local victim-services organizations and national hotlines remain available to support survivors and their families while the investigation moves forward.
