A Thursday evening walk on E. Rosedale Street turned deadly when Fort Worth police say a speeding driver, suspected of being drunk, struck a man crossing the road and kept going with him on the hood before finally stopping near Miller Avenue.
Officers responded to the 4000 block of E. Rosedale, where they found the pedestrian, later identified as 50-year-old Jack Vogt, unresponsive. Vogt was pronounced dead at the scene. The driver stayed at the location and was taken into custody.
Police identified the driver as 35-year-old Jory Durst. He was evaluated for suspected DWI, then arrested and charged with intoxication manslaughter, according to FOX 4 Dallas-Fort Worth. Investigators told the station the vehicle had been moving at a high rate of speed when it hit Vogt, then continued into a nearby parking area with the victim on the hood before finally coming to a stop. Fort Worth Police Department investigators have not released a measured speed or detailed charging documents.
Investigation and Charges
Durst is facing an intoxication manslaughter charge, a felony offense in Texas that can result in substantial prison time if prosecutors prove their case at trial. Under state law, intoxication manslaughter is defined in Penal Code §49.08. To support the charge, prosecutors typically lean heavily on toxicology reports, crash reconstruction, and other technical evidence, and certain circumstances can trigger enhanced penalties. For the statute language and penalty ranges, see the Texas Penal Code.
Pedestrian Safety in Context
Across Texas, pedestrian deaths continue to be a stubborn and tragic part of the traffic safety picture, with impaired driving contributing to a significant share of fatal crashes. State crash records and TxDOT’s annual summaries track recent totals and longer-term trends, highlighting how dangerous higher-speed multi-lane corridors can be for people on foot. For statewide numbers and the full crash overview, see the Texas Department of Transportation’s statistics page at TxDOT.
