Jordan Nelson is one of four qualified candidates for Davie Town Council’s District 3 seat, which voters will decide in the town’s Nov. 3 municipal election, according to CBS Miami. WSVN also identifies Nelson as a qualified candidate for the seat.
Nelson has pleaded not guilty to three DUI-related charges. CBS Miami, citing a court filing, reported that his attorney asked prosecutors on Tuesday to provide statements, photographs and test results related to the case.
What police allege
Davie police arrested Nelson early Friday, Sept. 25, after a single-vehicle crash near Hiatus Road and Orange Drive. According to CBS Miami’s account of a probable cause affidavit, the pickup struck a guardrail and a utility pole. Police said breath samples measured 0.173 and 0.163. Florida law sets 0.08 as the unlawful breath-alcohol level and provides enhanced penalties for a level of 0.15 or higher; the charges include DUI, DUI with a level above 0.15, and DUI with property damage. The statutory thresholds are set out in Florida Statute 316.193.
CBS Miami reported that investigators estimated damage at $6,500 to the guardrail and $16,500 to the utility pole. These are allegations and estimates reported in connection with the case; the charges remain pending.
