A Tulsa man is nursing a gunshot wound to the leg after what deputies say began as an argument and ended with a suspect returning with a gun near a West Tulsa levee. The Tulsa County Sheriff's Office is now searching for 28-year-old Gadien Wilson Deville, wanted on a charge of assault and battery with a deadly weapon in connection with the shooting.
Deputies were called to the area around the levee near Charles Page Boulevard and South 39th West Avenue around 5 p.m. on Tuesday, where they found a man with a gunshot wound to his leg, according to fox23.com. The victim told deputies he had gotten into an argument with Deville before the shooting occurred.
The victim said Deville left the scene of the argument only to return later with a firearm and shoot him. Additional witnesses at the scene backed up that account, telling deputies that Deville left following the dispute near 36th West Avenue and Charles Page Boulevard before coming back and opening fire, according to KOTV News On 6. That independent corroboration from bystanders adds weight to the victim's version of events as deputies continue building their case.
The Charge
If deputies catch up with him, Deville could face a charge of assault and battery with a deadly weapon. Oklahoma's Section 652 addresses shooting with intent to kill; injury-only shooting is addressed under Section 645.
Oklahoma's so-called 85% Rule applies to certain offenses. For those offenses, a conviction requires serving at least 85 percent of a prison sentence before becoming eligible for parole.

One of Several Violent Incidents This Week
The levee shooting was one of several gun and knife-related cases that kept Tulsa County deputies busy during the same stretch. The day before, an off-duty TCSO deputy was involved in a separate shooting near 41st and Sheridan after a suspect allegedly pulled a gun and fired at him; the deputy returned fire and injured the suspect.
For now, Deville remains at large.
