A Boston woman called police to her South End apartment early Halloween night into Sunday morning after she says she came home to find her ex-boyfriend, a Massachusetts State Police trooper, asleep in her bed. Officers responded to an address on East Springfield Street at 1:30 a.m. and arrested 37-year-old Michael McGuire of Quincy, who was charged with breaking and entering a building in the nighttime.

According to WCVB, the woman told police she and McGuire had agreed to meet up on Halloween and were together at a bar until about 10:30 p.m. She said she told him to leave because he was heavily intoxicated, then went home herself before returning three hours later to find him asleep in her bed.

The woman told officers McGuire did not have a key to her apartment and had refused multiple requests to leave, the police report states. She said she believed he had gotten inside by climbing the fire escape and entering through a window.

Conflicting Accounts of a Head Injury

Officers who responded noticed a small laceration on McGuire's forehead. Per the police report, McGuire said the woman hit him in the head while he was sleeping and that he was “out” for two minutes after being struck. He also told officers his apartment keys were on his keychain and may have been removed while he was asleep, the report says.

What the Breaking-and-Entering Charge Carries

Under Massachusetts General Law Chapter 266, Section 16, breaking and entering a building at night with intent to commit a felony can be punished by up to 20 years in state prison or up to two and one-half years in a jail or house of correction.

A Separate Trooper Under Internal Review

The arrest comes about three weeks after a separate Massachusetts State Police trooper came under internal scrutiny in an unrelated case. CBS News Boston reported that a trooper was investigated after allegedly leaving a handcuffed prisoner alone at Massachusetts General Hospital, with surveillance video appearing to show him sleeping in his cruiser outside. The department said the matter was the subject of an internal affairs investigation and declined further comment, and sources told the station the trooper remained on duty and had not been placed on administrative leave. That case is unrelated to McGuire's arrest.

WCVB reported on McGuire's arrest. No further details on a court date or McGuire's response to the charge were available.
