Darrick Miller is scheduled to be sentenced in Johnson County court at 9:15 a.m. Nov. 30 after pleading guilty Oct. 21 to attempted second-degree murder, FOX4 Kansas City reported. The charge was reduced from attempted first-degree murder. FOX4 described the plea offense as unintentional but reckless.
The case stems from a shooting call at the Healthcare Resort of Leawood, 143rd Street and Nall, at about 3:30 a.m. Feb. 10. In FOX4’s account of court documents, a disagreement over text messages between a coworker and Miller’s girlfriend, who also worked at the facility, escalated.
FOX4 reported that investigators’ video account and employee statements described Miller entering with a key card and firing toward the coworker near the nurses’ station. The coworker fired one shot in return, then went into an empty room with two nurses; Miller left the building, according to the station.
The Kansas City Star, citing the arrest affidavit, reported that no one was hit and no residents were involved. Investigators found multiple spent 9mm shell casings beside the nurses’ station, according to the Johnson County Post.
Workplace violence and emergency planning
The National Institute for Occupational Safety and Health classifies violence between coworkers in health care as Type 3 and says it can range from verbal and emotional abuse to homicide. Federal regulations require covered long-term-care facilities to maintain emergency-preparedness plans, reviewed and updated at least annually, based on documented facility- and community-based all-hazards risk assessments, according to the Electronic Code of Federal Regulations. That general requirement does not establish a workplace-violence-specific rule or indicate whether this facility complied.
