Alleged Serial Castro Arsonist Set To Be Released Again Next MonthPhoto: ABC7

Alleged serial Castro arsonist David Diaz, who was arrested again last November on suspicion of assault, is set to be released once more on March 16th, according to the Bay Area Reporter.

As you'll recall, Diaz was arrested on suspicion of assault with force likely to commit great bodily injury, false imprisonment, mayhem, and battery with serious bodily injury, and suspicion of unlawful use of a badge.

According to the B.A.R., Diaz allegedly handcuffed and bit a chunk out of another man's scalp while impersonating a police officer outside a club in SoMa. At the time of his November 29th arrest, Diaz's longtime partner Larry Metzger told the B.A.R. it appeared Diaz had been "hit with a pipe ... he looked pretty bad, he had stitches on his forehead.”

While the assault and other counts were dismissed, Diaz pled guilty on February 23rd to felony false imprisonment, and is expected to receive up to five years probation. The conditions of his release are expected to include a midnight curfew, and wearing an ankle bracelet for up to a year.

Deputy public defender Rebecca Young told the B.A.R. that Diaz's alleged victim was the first to strike during the incident, and that Diaz had a "very, very strong self-defense" case.

Diaz's long history of run-ins with the law dates to the June 2011 death of his sexual partner Freddy Canul-Arguello in Buena Vista Park. During his testimony, Diaz said that Canul-Arguello had asked to be choked while having sex and that Diaz had accidentally killed him.

Diaz was convicted in August 2014 of involuntary manslaughter, arson, mutilation of the remains of a human being, and destroying evidence. He was released the next month, after more than three years in custody.

In January 2015, Diaz was arrested again in connection to a fire at Up Hair in the Castro. Up Hair is located directly above nightclub The Mix, which is owned by Diaz's partner, Metzger, and where the couple also lived.

In August 2016, Diaz pled guilty to felony charges of possession of an incendiary device and commercial burglary.In addition to time served, he was sentenced to one year of mandatory supervision, registering as an arsonist for life, wearing an ankle monitor for the first six months of his release, and receiving counseling.

After being released in September 2016, Diaz was ordered to stay away from 4082-4086 18th St., the building where his former apartment, The Mix, and Up Hair are all located.

While Diaz was suspected in multiple fires at the time, District Attorney spokesperson Max Szabo told Hoodline that "the evidence only supported the one fire at Up Hair and The Mix. There was not sufficient evidence to charge him in the other fires."
