Federal prosecutors identified the driver as 26-year-old Christopher Gonzalez-Nunez, a Hayward man with alleged ties to the Norteño gang via KRON4. The woman in the photograph, not identified by name, is reportedly Gonzalez-Nunez's significant other. The identification was possible thanks to vigilant Instagram users who tagged Gonzalez-Nunez in photographs related to the incident and mentioned him by name according to Mercury News.

Adding to his digital footprint, the accused also posted a photo on his Instagram account, wearing a T-shirt that appeared to feature the viral image of his significant other, leaning out of the car brandishing the firearm.

Interestingly, the case against Gonzalez-Nunez isn't solely linked to the viral photograph. On August 11, he was charged with being a felon in possession of three guns and ammunition, reportedly discovered during a raid on his Hayward home via KTVU. The weapons, which included two unserialized pistols, were allegedly found inside a backpack disposed over a fence in the rear of his residence.

In addition to the firearms, large capacity "drum" magazines were found in a plastic grocery bag, along with firearm paraphernalia like a sight adjustment tool and a wrench used for modifying rifles. DNA evidence, as well as receipts connecting Gonzalez-Nunez to the items, were also found in his bedroom.

Prosecutors describe Gonzalez-Nunez as a member of the San Francisco Mission District Norteños with connections to high-profile gang members like Fernando Madrigal. Yet, the question of whether Gonzalez-Nunez remains jailed while awaiting trial is undecided, as the judge is scheduled to rule on the motion during a September 8 hearing. If convicted, he faces up to 15 years in federal prison.
