A Miami-Dade man faces a harrowing accusation of raping an 11-year-old girl after allegedly luring her with a marijuana-infused gummy inside Dolphin Mall's bathroom. David Rivero, 33, was taken into custody and hit with a felony charge of sexual battery on a minor by an adult. The disturbing turn of events unfolded on December 10, when the unsuspecting victim visited the mall, believing she'd be meeting friends, as her mother had dropped her off with that impression, as CBS Miami reported yesterday.
Police sources, including Detective Andre Martin, disclosed to CBS Miami, that while in custody, Rivero confessed to the crime. Running toxicology tests, investigators are working to confirm the presence of marijuana in the food item given to the girl. Tragically, the young girl was subjected to the ordeal in a family restroom, where she claims Rivero raped her, according to a police report.
After enduring such an ordeal, the girl confided in her mother, who promptly sought medical attention at Nicklaus Children’s Hospital. The staff's documents there echo the daughter's statements, relaying her allegation of having been raped by Rivero. Surveillance footage, which later emerged from the mall, corroborated the harrowing account, showing both Rivero and the girl entering and exiting the family restroom, according to NBC Miami.
As the legal proceedings take their course, Rivero remains behind bars, denied bond, and awaiting the next court appearance in 21 days for his arraignment. Meanwhile, a stern order has been issued against him to have no contact with the victim and to steer clear of the Dolphin Mall premises. It's worth noting, as of the time of the reports, that no attorney information was available for Rivero.
