
In an announcement that sparked palpable relief among Austin law enforcement but stirred consternation within the community, a Travis County grand jury this week dismissed charges against three Austin Police Department officers involved in a fatal June 2022 shooting. According to a report by KVUE, Officers Dennis Kerlin, John Zavala, and Spencer Bradley were cleared of any wrongdoing in the incident that led to the death of 42-year-old Carlos Eli Chacon-Castillo.
Reminiscent of a too-familiar narrative, the case stems from an encounter on June 12 when Officer Bradley approached Chacon-Castillo's stalled vehicle on East Koenig Lane and US 290. According to the same KVUE report, Bradley claimed that Chacon-Castillo was irate and armed with a knife. Things escalated rapidly when Officers Zavala and Kerlin arrived at the scene, and Chacon-Castillo allegedly charged the officers, leading them to use lethal force.
Despite officers' attempts at de-escalation, including the deployment of a less-lethal round by Officer Bradley, which proved ineffective, Chacon-Castillo was fatally shot. A report by KXAN confirmed that life-saving measures were attempted before Chacon-Castillo was transported to a hospital, where he was pronounced dead. The grand jury's decision aligns with DA José Garza's statement that “The District Attorney’s office takes the work of presenting all facts and evidence to a grand jury very seriously,” indicating the officers' conduct was found not to be unlawful.
Since January 1, 2021, the DA’s office has revealed that out of 94 cases presented to grand juries against officers, 61 have resulted in a no-bill, including the case involving Kerlin, Zavala, and Bradley. The frequency of such outcomes hints at overarching questions regarding the efficacy of the system in holding officers accountable, despite claims of rigorous fact-presenting by the DA’s office.
