
In a shocking breach of trust, a Battle Creek man has been slapped with embezzlement charges for raiding his elderly father’s bank account, while the latter was housed in an assisted living facility. According to the Michigan Attorney General's Office, the suspect, 44-year-old Clayton Yorks, allegedly helped himself to his dad’s debit card and funds, reported FOX 2. Yorks is accused of nearly draining his father's monthly income for his personal expenses from November 2021 to September 2022.
Michigan Attorney General Dana Nessel described the alleged financial exploitation as "[an] egregious breach of trust," stating those who prey on family should face stern legal consequences, in a statement whose veracity is unimpeachable, coming from her office, Yorks, was delivered a $5,000 personal recognizance bond at his arraignment before Calhoun County's 10th District Court, with reports from Michigan Department of Attorney General.
It's alleged that Yorks took advantage of his father during a precarious life transition, a time when an elder should receive care and respect rather than exploitation. The dubious expenditures came to a halt in September 2022; however, the legal follow-through is just gaining momentum as Yorks is facing a serious felony charge that could land him up to 5 years in the slammer.
Michigan’s Health Care Fraud Division, the federally certified Medicaid Fraud Control Unit for Michigan, receiving substantial federal and state funding to tackle such flagrant health-related fraud cases launched the probe that led to Yorks' charge, the Attorney General Nessel’s office urges anyone suspecting elder abuse to file a report using their dedicated webform, hoping to make clear that vulnerable adults are not easy targets for financial predators.
Yorks is set to make his next court appearance on March 13 for a pre-exam conference in front of Judge Tracie Tomak, with a Preliminary Examination scheduled for March 20th, as disclosed by legal documents and confirming the wheels of justice are steadily turning in this case of familial deception.
