Charges have been dismissed against a Southwest Ranches volunteer firefighter who was embroiled in controversy after a car crash that injured his daughter and killed another woman. Vidal Lazo, a lieutenant with the volunteer fire department, was involved in the fatal accident on December 21, where his 3-year-old daughter sustained serious injuries, and 77-year-old Ileana Mendigutia lost her life.
The Miami-Dade State Attorney's Office decided to drop the charges after evidence suggested that Lazo had suffered a seizure before the crash. As reported by NBC Miami, the prosecutors said, "There is insufficient evidence to sustain the charge of child neglect causing great bodily harm. As a result, the only proper and ethical option available to the prosecutor was to drop the filed criminal charge." Toxicology reports after the accident had shown Lazo tested positive for opiates, methamphetamines, and ethanol, raising initial concerns over his capacity to drive.
Erick Cruz, Lazo's attorney, has maintained his client's innocence, stating that the presence of drugs in Lazo's system was a result of medical intervention. "Immediately after the accident, he was rushed to the hospital. He had surgery, he was under an incredible amount of pain and he was given morphine to deal with the pain. That caused the positive test results," Cruz told NBC Miami.
The traffic mishap occurred on Bird Road and Southwest 134th, as detail confirmed by WSVN. Lazo was arrested on New Year's Day following the crash. Despite the circumstances, local authorities recently concluded there wasn't enough evidence to proceed with a conviction, leading to the dismissal of the child neglect charge against the lieutenant.
This development marks a turn in the legal battle for Lazo, who has been cleared from the accusations that stirred community concern and brought attention to the intersection of personal health crises and public safety responsibilities.
