
The American Civil Liberties Union of Indiana has initiated legal action against the City of Loogootee, alleging that city officials have intentionally obstructed the execution of the PrideFest 2024 event, as stated in a report by FOX59. The ACLU filed a lawsuit on Thursday in the US District Court on behalf of PrideFest organizers, the Patoka Valley AIDS Community Action Group, after the city council rescinded an earlier approval and ushered in changes to the event application process without addressing the new application for the Pride event.
In what is being viewed as discriminatory treatment, the ACLU points out that a different gathering, Summer Fest, seems to be moving ahead on the same Public Square without the event organizers being required to navigate the permit process. The new city ordinances imposed by the city council, have not impeded the Summer Fest, yet remain a barrier for the PrideFest 2024, per the ACLU's observations.
According to WTHR, the ACLU claims that the City of Loogootee's cancellation of its original November 2023 permission for PrideFest 2024, along with its additional actions, "violate the First Amendment to the United States Constitution." Ken Falk, ACLU of Indiana's legal director, explained, "The latest city special events ordinance is unconstitutional in many ways. It, and the actions of the City Council, clearly indicate that Councilmembers are trying to deny our plaintiffs the ability to hold their event because they disagree with a celebration of the LGBTQ community."
The inaugural Pride Festival in Loogootee took place in June of 2023 and observed a turnout of about 200 people. It was held at the Public Square, a traditionally communal place where townsfolk would typically come together for public events. After the 2023 festival's success, the sponsors submitted a new application for the next year's festival in February 2024 and continued to attend council meetings, yet they were met with silence on the part of the City Council, as reported by the ACLU of Indiana.
The ACLU is now beseeching the court to override the Loogootee Special Events Ordinance, to ensure that PrideFest 2024 can proceed as planned on September 7 at the Public Square. The ACLU's legal challenge is a critical attempt to uphold the constitutional rights of the organizers and the community seeking to celebrate Pride amidst what they contend as obstructive and discriminatory legislative barriers imposed by the city officials.
