U.S. Attorney Markenzy Lapointe for the Southern District of Florida has unveiled the Whistleblower Non-Prosecution Pilot Program. This initiative aims to motivate individuals, through the promise of non-prosecution agreements, to voluntarily confess and provide insider details on fraudulent and corrupt actions within corporations, touching on financial crimes, health care fraud, and public malfeasance, as announced in a recent press release.
The program sets out clear rules engaging individuals to self-report and assist authorities, ideally leading to corrective measures, while also necessitating that the informer compensates the victims, this approach aligns with Deputy Attorney General Lisa Monaco’s emphasis on accountability in corporate crime as expressed in her remarks at the American Bar Association's 39th Annual National Institute on White Collar Crime. Monaco pointed to the Justice Department’s delicate balance of incentives and punitive measures in encouraging self-reporting of such offenses.
“We encourage people who qualify for the Whistleblower Program to take advantage of the opportunity to come clean, cooperate, and get on the right side of the law,” Lapointe said in press release, urging individuals with relevant information to step forward proactively by reaching out through the dedicated email, [email protected], provided by the office. The Southern District of Florida’s effort is in line with a larger set of actions, including the Justice Department’s Corporate Whistleblower Awards Pilot Program, which rewards whistleblowers who come forward with previously unknown information about certain types of financial crimes.
