
The City of Las Cruces has settled a civil lawsuit with the family of Teresa Gomez, agreeing to a settlement of $20 million, as reported on November 25th. Gomez was fatally shot by former Las Cruces police officer Felipe Hernandez during an incident on October 3, 2023. The family of Teresa Gomez filed a lawsuit following the tragic event, leading to this resolution.
In charge of second-degree murder, former officer Hernandez was arrested after the Las Cruces Police Department found probable cause. Walking through the early-morning hours of an October day, it was this period in 2023 when the altercation that led to Gomez's death occurred. Hernandez has since been relieved of his duties and is awaiting a criminal trial set for June 2, 2025.
Although the Las Cruces City Council held meetings behind closed doors to deliberate on the settlement, an ordinance will be presented in January 2025 to approve the funds needed to finance this agreement. The settlement represents the City's most substantial in a civil lawsuit, evidencing their determination to address and resolve this matter.
It is of note that the City maintains the presumption of innocence for Hernandez, as his criminal trial is yet to take place. According to the City of Las Cruces, regarding the implications of the settlement, they stated, "The settlement reached with the Gomez estate should in no way indicate criminal guilt by Hernandez." The City also expressed that this settlement reflects the profound loss felt by the Gomez family after the tragic circumstances of her passing and extends their condolences to her family.
