In a high-profile legal dispute, the defense team for Chicago rapper Lil Durk, legally known as Durk Banks, has criticized the prosecution's decision to use his song lyrics as evidence in a federal murder-for-hire case. Banks is accused of orchestrating a plot targeting Georgia rapper Quando Rondo, which led to the fatal attack on Rondo’s cousin. Defense attorneys argue that relying on lyrics from Banks’ music demonstrates a weak case, asserting that the prosecution lacks concrete evidence to support the charges.
The legal team's statement, as reported by the Chicago Sun-Times, conveys their view that the usage of song lyrics is a "glaring indication that there is no real evidence" and labels it as "false and lacking in the most basic due diligence." Banks faces further charges in a superseding indictment, which could result in life imprisonment, and has been held without bail since his arrest on October 24. Notwithstanding the gravity of his situation, Banks maintains his innocence and pleaded not guilty at his arraignment last month. A detention hearing is slated for December 12, with the trial set for January 7.
The indictment claims that Banks' music label, Only the Family, functioned as more than an artistic venture, dubbing it a hub for violent criminal activity. Prosecutors insist that members of the label committed acts of murder and assault at Banks' behest to solidify their status within the organization. The details of the case involve allegations of bounties placed on targets, including Rondo, and potential rewards tied to successful executions of these violent bids. All these claims build a narrative that paints Banks as the leader orchestrating these grave actions.
Furthermore, the prosecution alleges that an accomplice booked travel and accommodation in Los Angeles using credit cards linked to Only the Family, despite Banks' explicit instruction to avoid paper trails connected to him. His attorneys say prosecutors are overreaching when they claim that the lyrics of one of Banks’ songs may be quoted as evidence, according to the WGN-TV report. This trip preceded the attack that took place in August 2022 and resulted in the loss of Rondo's cousin's life. The murder-for-hire plot is believed to be a retaliation for the 2020 killing of King Von, a protege of Banks, who died following a confrontation with Rondo's entourage in Atlanta.
