
In a straightforward turn of events, Juan Garcia Xinol, a 27-year-old Mexican national, has admitted to illegally reentering the United States, a federal offense that could lead to a two-year stint behind bars. Garcia Xinol's guilty plea was accepted, with the sentencing date set for May 23, 2025, according to a press release from the U.S. Attorney's Office for the Middle District of Florida announced earlier today.
The journey to Garcia Xinol's guilty plea began with his arrest in December 2022 on charges including methamphetamine possession and providing a false identity to police officers, coupled with four outstanding Polk County warrants. Following his conviction, he violated probation related to a domestic battery case, which led law enforcement to apprehend him once again in May 2024. At the time of his second arrest, officers found him in the Polk County Jail.
A subsequent investigation by officers with the U.S. Immigration and Customs Enforcement (ICE) Enforcement and Removal Operations (ERO) unearthed that Garcia Xinol had been previously deported from the U.S. on October 6, 2020. His presence in the U.S. following this removal lacked the proper admission or parole by immigration officers, thus classifying it as illegal reentry.
Assistant U.S. Attorneys Karyna Valdes and Lindsey Schmidt, along with ICE ERO, secured charges against Garcia Xinol. He has pled guilty to illegal reentry after removal and now awaits sentencing, which could result in up to two years in prison, the maximum penalty for this offense.
