
A former Martinsville school teacher accused of group sex with students is now entangled in a series of legal actions, with an Indianapolis legal firm initiating a lawsuit against Martinsville Schools. The teacher, Brittany Fortinberry, is facing additional charges as more alleged victims come forward, and currently five charges are held against her with the prosecutor seeking to add more, reported WTHR.
In a news release from a personal injury and sexual abuse law firm today, an attorney sent an Indiana Tort Claim Notice accusing the Metropolitan School District of Martinsville of negligence following an incident in which a male student was allegedly molested and provided drugs by Fortinberry while he was enrolled at John R. Wooden Middle School in the fall of 2023. The attorney is quoted as saying their aim is to "prevent this type of abuse from happening to other students in the future," information that was obtained by FOX59.
Adding to the unfolding drama, lawyers representing the 13-year-old claimant are seeking $700,000 per incident of sexual assault from the school district, asserting that the victim requires compensation for both physical and emotional traumas as well as associated sufferings. This financial demand is bolstered by allegations that the school district administrators not only ignored previous signs of Fortinberry's improper behavior but also neglected to effectively report her conduct or take action to protect students after her abuse was discovered, as revealed in a statement published by WISHTV.
The matter raises concerns over the school district's response to such serious accusations with the law firm representing the victim remarking that the district has 10 days to issue a written acknowledgment of the Tort claim notice, while the district's own countermeasures have yet to be disclosed; one poignant statement by a lawyer reads: "Our preliminary investigation suggests that the school district's administrators knew about inappropriate behavior by Ms. Fortinberry but still chose to hire her" according to WISHTV, the district's handling of the allegations against Fortinberry and their implications for the affected students and families remains the focal point of a narrative that is still unfolding.
