The legal community is facing a reckoning in Tennessee as the state Supreme Court has upheld the suspension of Shelby County attorney, Daryl A. Gray, for alleged ethical transgressions. According to a report from the Tennessee Courts, the decision comes in the wake of two separate complaints against Mr. Gray, pointing to a series of violations the legal practitioner has been accused of.
The violations revolve around Mr. Gray's practices in two personal injury lawsuits. In the first instance, he improperly handled a client's settlement funds, failing to pay a medical provider with a valid claim to the proceeds and was found to have misrepresented the situation. In a different suit, Gray made the procedural misstep of suing the wrong party and did not serve the amended complaint on the correct defendant. He further failed to effectively communicate with his client about a motion to dismiss and was slow to formally withdraw his representation. A hearing panel set out to decisively examine these complaints and concluded that they merited a six-month suspension for Gray, with four of those months on probation.
Despite the sanctions, Mr. Gray moved to challenge the suspension, arguing that the evidence was insufficient, the panel's decision was arbitrary, and the punishment too severe. However, the Tennessee Supreme Court found that "the hearing panel’s determinations that Mr. Gray violated the ethics rules were supported by substantial and material evidence." In its verdict, the Court found the panel neither arbitrary nor capricious and held that Mr. Gray did indeed violate six ethics rules, making the imposed sanction appropriate.
Upholding the decision, the Tennessee Supreme Court has now affirmed the suspension of Daryl A. Gray's law license. This serves to send a clear message to the legal fraternity about professional responsibility and the consequences of failing to rigorously uphold the ethical standards set forth by the bar. It goes without question, the Court strives to maintain the belief that practitioners within the system must act diligently and truthfully, both to their clients and the court itself, in order to truly preserve the integrity of the legal system.
