According to an arrest report obtained by Local 10, after the assault, witnesses including Chili's employees, who have asked not to be identified, said that Brown approached the victim while they were bussing a table and punched them squarely in the face. This blow caused the victim to fall and to immediately lose consciousness. Further escalating concerns, there were threats made by Brown's family members, who allegedly warned witnesses they would shoot them if they continued to follow them to their vehicle.

Police response was swift as officers were guided to a nearby parking garage by an off-duty officer, where Brown had fled. Upon arrival, witnesses helped police locate Brown, who was attempting to quickly leave in a vehicle. Police managed to detain him at gunpoint. Following the arrest, a review of surveillance video from inside the Chili's confirmed the witnesses' account of the assault, showing Brown striking the victim and proceeding to stand over the fallen employee, "clenching his fist," as per the arrest report, Local10 detailed.

Brown was subsequently arrested and charged with aggravated battery causing great bodily harm. The report further noted that Brown's family mentioned he suffers from some sort of disorder—an assertion Brown himself denied, stating that he does not suffer from any mental illnesses or learning disabilities.
