
In the tangled web of Medicare fraud, Jacobo Melcer, an 85-year-old Bonita resident, has pleaded guilty to charges that echo with greed and deceit. During a federal court session, Melcer admitted his role in a scheme that saw Medicare defrauded of nearly $6 million through operations at two medical equipment companies he owned. This admission comes as the result of an investigation by the Federal Bureau of Investigation and the U.S. Department of Health and Human Services Office of Inspector General, with Assistant U.S. Attorney Blanca Quintero spearheading the prosecution in the Southern District of California.
With Melcer at the helm, his businesses churned out an array of orthotic devices, including back braces and knee supports, with claims to Medicare exceeding $5.88 million, all proved to be fraudulent. Pleading guilty to a charge that carries a maximum penalty of five years in prison and a half-million dollar fine, according to the Justice Department. His plea acknowledged the illegal kickbacks exceeding $227,000 that fattened the streams of referral to his doorstep, along with false prescriptions signed by doctors who might as well have been ghosts to the patients they allegedly saw.
The stroke of Melcer's pen on those fraudulent claims translated into a windfall of over $3.4 million from Medicare's coffers. In his guilty plea, he acknowledged the extent of his deception, agreeing to forfeit and restitute the full amount received from the scheme. The final reckoning for Melcer's actions is slated for October 10, 2025, when he will return to court for sentencing.
Further compounding his fraudulent endeavors, Melcer admitted to the calculated sale of two durable medical equipment companies to an unnamed accomplice, purposefully masking the true ownership from Medicare's prying eyes due to previous suspensions. Evidently, the co-conspirator, bound by Medicare's previous sanctions, found in Melcer an ally in the shadowy art of skirting regulatory oversight, according to court documents obtained by the Justice Department. The consequence of these actions remains encapsulated in the charges Melcer faces as he awaits the impending date with destiny that will indelibly mark the remainder of his years.
