A Miami-Dade deliveryman, Janier Flores-Borrego, was arrested last week on charges of attempted sexual battery with no serious personal injury and lewd and lascivious molestation of an elderly or disabled adult during a service call at a 65-year-old woman’s home.
According to NBC Miami, authorities said Flores-Borrego closed the door to the woman’s laundry room during the delivery, exposed himself, and attempted to sexually batter her. The victim reported that he also forcefully grabbed the back of her head against her will. He was later released on a $15,000 bond with house arrest and must comply with an 11 p.m. to 6 a.m. curfew.
Legal analysis from Flanagan and Bodenheimer notes that companies could face liability in such cases under negligent hiring, retention, supervision, or vicarious liability, especially if proper background checks were not conducted or if the employee’s role enabled the misconduct. Florida courts have ruled that businesses have a duty to ensure employees entering customer homes are properly vetted.
