The tragic death of Gabriel Palacios, a 13-year-old student at Coronado Middle School, has led his family to sue Coronado Unified School District, as detailed in a series of reports by various news outlets, including East Bay Times, NBC 7 San Diego, and Hoodline. The complaint alleges that the school failed to protect Gabriel from severe bullying, which his family believes led to his suicide in April.
According to the NBC 7 San Diego report, the lawsuit claims that after Gabriel inadvertently shared a sensitive video on social media, bullying intensified, resulting in harassment and mockery at school. Despite Gabriel and his mother approaching school authorities, their attempts to address the situation were allegedly dismissed. "I saw his voice and mine dismissed and deemed irrelevant by the middle school authorities," Orsolya Palacios, Gabriel's mother, said per Hoodline.
The family also accuses the school administration of subjecting Gabriel to unfair discipline, citing an incident reported by the East Bay Times in which he was suspended for allegedly bringing a weapon to school, which was actually a bottle opener. The family lawyer, James Carraway, emphasized that Gabriel's Individualized Education Plan (IEP) should have acted as a protective framework but was ignored by the school district.
"Gabriel's death was entirely preventable," attorney John Gomez said, per NBC 7 San Diego. He lamented the lack of care and protection for Gabriel, suggesting that the district had many opportunities to intervene but chose not to. Mercedes Smith, president of the CMS Parent Teacher Organization, also addressed the issue, stating during a press conference reported by Hoodline, "We failed his family" – acknowledging a community responsibility in the wake of Gabriel's ordeal.
