
A Utah inmate already serving time for a child sex conviction is now staring down a fresh stack of charges, after investigators say sexually explicit photos of a minor surfaced. Prosecutors filed the new counts Thursday as recently uncovered digital evidence, along with a discovery by a family member, came to light, according to court filings.
Custody and the Task Force Handling the Case
According to the Utah Department of Corrections, the Central Utah Correctional Facility in Gunnison houses male inmates and handles prisoner transports to court across the state. The investigation also involves Utah's Internet Crimes Against Children task force, and the Office of the Utah Attorney General lists an ICAC tip line for reporting at (801) 281-1211. In recent years, the state task force has stepped up its digital forensics work and prosecutions tied to online exploitation.
Charges and Recent Case History
Court documents reviewed by ABC4 Utah show prosecutors filed 10 counts of aggravated sexual exploitation of a minor against Brian Baity. The filings state that Baity previously pleaded guilty in 2024 to one count of sodomy on a child and was serving an indeterminate 10-year-to-life sentence when investigators say the new material was discovered. Charging papers also note that a warrant has been issued so Baity can be transported for upcoming court appearances.
What the Charges Mean Under Utah Law
Under Utah law, aggravated sexual exploitation of a minor is a first-degree felony. As outlined in Utah Code Section 76-5b-201.1, each image or separate depiction can often be charged as its own offense, according to Justia. A separate statute, Utah Code Section 76-3-203.6, allows for enhanced penalties when a prisoner commits certain felonies while already serving a sentence, including in some circumstances, life in prison without the possibility of parole, per FindLaw.
How Investigators Say the Images Were Discovered
Charging documents described in the ABC4 Utah report say a family member found a folder containing nude photographs on Oct. 16, 2025, in West Valley City and turned the material over to police. A West Valley City Police detective later recovered roughly 120 images from a hard drive, according to the filings. Prosecutors allege Baity groomed the girl into what is described as a romantic relationship between November 2020 and June 2021, when she was 13 years old, and that some of the photos appear staged like a photoshoot.
A warrant has been issued to transport Baity to court for hearings on the new charges, according to the charging documents.
