A 63-year-old Crystal Lake woman has been convicted after a jury found her guilty in the injury of an 11-month-old boy who was in her care at a home daycare. Prosecutors said the child suffered a fractured rib during a forceful diaper change in 2024.
According to the Chicago Tribune, the McHenry County jury deliberated for about an hour after a three-day trial before finding Ann Migliorato guilty of three counts of aggravated battery to a child and one misdemeanor count of unlawfully operating a childcare facility. Her sentencing is scheduled for October 8.
Video Put Diaper Change At Center Of Trial
The case centered on video recorded by a 10-year-old girl at the unlicensed daycare in the 1400 block of Woodscreek Circle, according to court details reported by Patch. Prosecutors said the footage showed Migliorato using her body weight to restrain the infant and forcing his legs above his head while changing his diaper.
Medical testimony indicated that the boy had one fractured rib and two additional healing rib fractures that were consistent with prior abuse, the Tribune reported. The video also captured Migliorato berating the child, evidence prosecutors used to argue that the injury was not an accidental mishap during routine care.
Case Began With An Unlicensed Daycare Investigation
Migliorato’s conviction follows charges filed in 2024 after authorities investigated alleged abuse at the home-based operation. Hoodline’s earlier coverage reported that she faced felony battery counts, a strangulation-related charge and a misdemeanor for operating the childcare facility without the required license.
Sentencing Could Bring Mandatory Prison Time
Under the general Illinois Class X felony sentencing framework, a conviction carries a prison term of six to 30 years and does not permit probation, according to the Illinois General Assembly. The precise sentence will depend on the court’s treatment of the individual counts and the circumstances presented at the October hearing.
