A 44-year-old man once living with the mother of an 11-month-old Aurora boy is now charged with first-degree murder in the child's 2010 death, after investigators say a specialized medical review finally pinpointed when the fatal injuries occurred. Spiros Elias was arrested in Burlington on August 21 and appeared in court Friday, where a Kane County judge ordered him held without release ahead of an October court date.
The infant, Michael Ortiz, died in December 2010 after suffering injuries that a forensic pathologist later attributed to violent shaking, strangulation, and blunt-force trauma, according to prosecutor statements reported by the Daily Herald. Emergency responders managed to revive Michael at the time, but he died the following day. Elias was the live-in boyfriend of Michael's mother when the boy died, and the family was sharing a residence on the 100 block of Cross Street in Aurora with the mother's two other children and several other adults, the household context the Herald laid out from the case record.
Prosecutors told the court that about 90 minutes after Michael's mother left for work that day, Elias called 911 and reported that the baby had turned purple and stopped breathing after choking on milk from a sippy cup. As WSPY News reports, the original 2010 investigation documented injuries consistent with child abuse but could not determine at the time who was responsible, and investigators were unable to disprove Elias's account immediately. The DuPage County Coroner's Office, which evaluated Michael's injuries after his death at an Aurora hospital, officially classified the case as a homicide caused by child abuse, according to autopsy records and police releases cited by Patch.
A Cold Case Reopened With New Science
The case sat unresolved for well over a decade until Aurora's dedicated cold case investigator began a fresh review of the file in December 2024, re-examining physical evidence, revisiting original case files, and re-interviewing key witnesses, Patch reported. That renewed effort brought in an independent pediatric radiologist for specialized analysis, which Aurora Police say helped establish a refined timeframe for when Michael's fatal injuries occurred.
Investigators then cross-referenced that narrowed window against witness statements collected back in 2010, a process that pointed to Elias as the suspect, according to the police statement reported by Shaw Local. A Kane County grand jury indicted Elias on two counts of first-degree murder on August 18, and Aurora police, working with the U.S. Marshals Great Lakes Regional Fugitive Task Force, arrested him in Burlington three days later.
Prior Case, Defense Pushback in Court
During Friday's detention hearing, Kane County State's Attorney Jamie Mosser told the court that Elias had previously been charged with murder in 1999, though that charge was later dropped; he was instead convicted of aggravated discharge of a weapon and sentenced to six years in prison, the Herald reported.
Defense attorney Brandon McNulty countered that Elias posed no danger to the community, pointing to the 16-year gap between the infant's death and the new charges as well as the absence of any violent crime charges against Elias since his release from prison. Kane County Judge Bianca Camargo was not persuaded, denying pretrial release and ordering Elias detained in the Kane County jail. He is due back in court October 15 under Illinois's SAFE-T Act detention standards, the report noted.
Elias has not been proven guilty in court, and the charges against him remain allegations at this stage of the case.
