A 22-year-old McHenry man is facing felony stalking, unauthorized recording and property damage charges after police say he crouched beside a woman inside a local Meijer store and positioned his cellphone near her buttocks. Kishaun Davis was arrested near his McHenry home following an investigation that began after a 31-year-old woman reported the encounter to police.
The investigation started on July 9 after the woman told officers she noticed a man crouched beside her with his phone near her body inside the Meijer store on North Richmond Road in McHenry, according to FOX 32 Chicago. Investigators developed probable cause that Davis recorded the woman's intimate parts by placing his phone near her loose-fitting clothing, police said, and the suspect left the store after being confronted. That North Richmond Road corridor is one of the region's busiest retail stretches, drawing shoppers from across northern Illinois and southern Wisconsin, according to the City of McHenry Economic Development Corporation.
Investigators identified Davis as a suspect, and a forensic review of his cellphone allegedly connected him to several other reported incidents in McHenry and surrounding areas, per police and the McHenry County State's Attorney's Office. Davis was ultimately charged with three counts of stalking, one count of unauthorized video recording of a person's intimate parts or undergarments, and one count of unauthorized video recording or transmission at a residence.
Vehicle Damage and Months of Alleged Surveillance
Beyond the Meijer incident, police allege Davis followed unsuspecting women to their homes or workplaces between March and July of this year. During that same stretch, he allegedly caused significant damage to some of the women's vehicles, according to police. Those allegations resulted in two counts of criminal damage to property between $500 and $10,000, plus four additional counts of criminal damage to property valued at less than $500.
Under Illinois law, property damage in that $500 to $10,000 range is charged as a Class 4 felony, while damage valued at $500 or less is a Class A misdemeanor punishable by up to 364 days in jail, according to Eric Blatti Law. The stalking counts themselves carry heavier stakes: a first-offense conviction under 720 ILCS 5/12-7.3 is a Class 4 felony punishable by one to three years in state prison and fines up to $25,000, per the Illinois General Assembly. The unauthorized recording charges carry the same one-to-three-year range under 720 ILCS 5/26-4, which criminalizes filming a person's intimate parts or recording inside a residential dwelling without consent.
Held Without Bond in Woodstock
Davis was taken to the McHenry County Jail in Woodstock, the county seat located roughly 12 miles west of McHenry where the McHenry County Government's jail and 22nd Judicial Circuit Court facilities are based. Since Illinois eliminated cash bail under the SAFE-T Act in September 2023, prosecutors can petition to detain stalking defendants without pretrial release if they present clear and convincing evidence of a real and present safety threat, according to Illinois Legal Aid Online. It remains unclear what specific pretrial detention ruling prosecutors will seek during preliminary hearings.
The McHenry County State's Attorney's Office said the investigation remains ongoing, and the McHenry Police Department echoed that the case is still active. Police say Davis may be connected to other cases still under review as the forensic digital examination continues, and it is not yet known whether additional victims will come forward.
This is not Davis's first contact with McHenry police. In April 2022, when he was 18, he was charged with two counts of criminal damage to property, two counts of retail theft, and two counts of unauthorized possession of license plates, according to Shaw Local.
Part of a Wider Pattern at Suburban Chicago Stores
Davis's arrest follows a string of similar cases across the Chicago suburbs this year. Hoodline previously reported on a McHenry man's Meijer arrest after 20-year-old Jerardo Hernandez Alonzo was charged with felony unauthorized video recording for allegedly secretly filming shoppers inside a Sycamore Meijer store in April. In June, a 28-year-old Frankfort man was charged with felony unauthorized recording after a church visitor found a hidden cellphone filming inside a New Lenox restroom, as reported by NBC Chicago.
McHenry, a city of 27,135 residents as of the 2020 U.S. Census located about 50 miles northwest of downtown Chicago, has now seen two Meijer-related recording cases within the same year.
