An 86-year-old Port Jervis man who admitted to fatally stabbing a fellow resident at his assisted living facility was sentenced to the maximum term of 5 to 15 years in state prison. James Annear appeared in Orange County court using a wheelchair and oxygen as he received the sentence for the death of 62-year-old Patricia Winters, who died at The Sentinel of Port Jervis.
Annear pleaded guilty to second-degree manslaughter in connection with Winters's death, according to News12 Hudson Valley. Judge Craig Stephen Brown imposed the maximum sentence allowed, finding that the circumstances called for it, per the same report. Authorities said Annear stabbed Winters in the neck. The argument reportedly concerned a benefit card and $200, after which Winters grabbed a knife and threatened Annear.
How the Confrontation Unfolded
Winters was found dead from a stab wound inside a bedroom at the facility, according to Newport Dispatch, which reported that police responded to a report of an assault at The Sentinel of Port Jervis at approximately 11:39 p.m. on Dec. 13. Annear was also found in that same bedroom suffering from what authorities described as apparent self-inflicted stab wounds, and he was treated at the scene before being transported to a hospital in critical condition, the outlet reported. Investigators determined that a verbal confrontation between Annear and Winters had turned physical before the stabbing occurred, per Newport Dispatch's account.
Notably, authorities initially indicated Annear would face a second-degree murder charge once his medical condition permitted arraignment, according to Newport Dispatch's original report on the case. The case ultimately resolved with Annear's guilty plea to the lesser charge of second-degree manslaughter, which under New York Penal Law Section 125.15 applies when a person recklessly causes another's death, according to the New York State Senate.
Prosecutor and Judge Speak at Sentencing
Prosecutors said Winters deserved better, according to the same News12 Hudson Valley report.
The Orange County District Attorney's Office said Annear and Winters knew each other and that a verbal argument escalated into deadly violence, according to News 12 Westchester. Annear's roommate was the only witness, and staff members discovered both Winters and Annear afterward. Former employees told the station that Annear and Winters had been romantically involved while living at the facility for three years, though that detail was attributed specifically to former staff rather than to investigators.
Facility's Safety Record Raises Questions
Former employees also raised broader concerns about safety and oversight at The Sentinel of Port Jervis, including questioning how Annear was able to obtain a knife inside the facility, per the News 12 Westchester report. State Health Department records cited by the station showed the facility had been cited for 30 violations over the preceding four years, and a complaint investigation conducted the previous month resulted in 20 violations, some involving resident protections that state records said were later corrected.
An Unusual Case for the County
The Orange County District Attorney's Office identified Annear as the oldest defendant in the county sentenced to state prison for a significant crime since at least 2003, based on electronic records, according to News12 Hudson Valley.
