
The immediate question for affected nurses is how Kaiser will carry out the arbitrator’s award. Kaiser says it will contact each affected nurse promptly and honor its obligations, while the union says the ruling covers more than 1,000 nurses at California facilities and could involve tens of millions of dollars in back pay dating to at least 2021.
Union Says Arbitrator Ruled Against Kaiser
The California Nurses Association, which represents more than 25,000 nurses at 22 Kaiser facilities around California, says it filed a grievance in 2024 over the pay discrepancies and the dispute went to arbitration, with an arbitrator issuing a decision on Sept. 30 awarding back pay. As reported by National Nurses United, the union says it “successfully won an arbitration agreement that mandates Kaiser pay stolen wages dating back to at least 2021.” The San Francisco Chronicle reported Kaiser must pay up to tens of millions of dollars to the more than 1,000 affected nurses.
California Nurses Association President Michelle Gutierrez Vo, a registered nurse in the Adult and Family Medicine Department at Kaiser Fremont Medical Center, attributed the underpayments to a payroll-system overhaul and accused Kaiser of allowing errors to continue, according to the union’s statement. The union says the payroll problems followed a change to Kaiser’s system dating back to at least early 2021.
Kaiser Disputes the Union's Framing
Kaiser Permanente, based in Oakland, disputes the union’s characterization of the matter. The health system says it is committed to ensuring every nurse is paid accurately and in accordance with the contract, according to the Chronicle’s reporting.
The payout comes as the union remains locked in active contract negotiations with Kaiser. Earlier in the year, nurses at Kaiser hospitals held informational pickets protesting wage theft alongside other bargaining issues, the union's statement notes. A separate union release says nurses at the 22 California facilities held informational pickets on Sept. 1 to protest concerns including safe staffing and artificial-intelligence protections.
A Recurring Fight Over Healthcare Payroll
Kaiser's bargaining page states that Kaiser Permanente and the California Nurses Association held bargaining sessions on July 7, 9, 20, 24 and 27, describing them as productive. Payroll disputes have surfaced elsewhere in California healthcare before: in 2022, nurses and healthcare workers demanded that Sutter Health fix payroll errors they said had begun the previous month, according to CBS San Francisco. Nurses who worked for Kaiser Permanente and Permanente Medical Group also sued over alleged unpaid wages in 2016, according to a blog post from law firm Sommers Schwartz.
Statewide wage recovery offers broader context
The Kaiser dispute is separate from the state’s wage-claim process. For statewide context, the California Labor Commissioner’s Office reported that its Wage Claims Adjudication Unit recovered $39,826,743.09 in calendar year 2021. That figure shows wage recovery through a separate enforcement process; it is not part of the Kaiser arbitration or an estimate of its award, according to the California Labor Commissioner’s Office.
The remaining question is how the ruling translates into individual payments. Kaiser and the union have not made public the arbitrator’s full decision, including how the final total was calculated or how individual payments will be determined.
